Woman awarded $6.45M after court entered default judgment in revenge porn case

A woman who was a victim of revenge porn was awarded $6.45 million in damages after California federal district court entered a default judgment against her ex-boyfriend who was accused of spreading her naked photos and videos online.

In a report by CNN, the woman who was listed as Jane Doe filed the case against David Elam II in civil court in 2014 for alleged copyright infringement, online impersonation with intent to harm, stalking and the intentional infliction of emotional distress.

The victim was granted $450,000 in damages due to copyright infringement, $3 million for emotional distress in compensatory damages, and $3 million in punitive damages.

Doe chose to copyright her breasts in order to remove her intimate photos off the internet as the pictures were sent to Elam while they were in a relationship, meaning it was given with her consent.

The copyright registrations enabled Doe to remove the photos from some websites.

A Seattle couple was earlier awarded $8.9 million, the largest money granted in a non-celebrity revenge porn case.
